MyCOURTpilot

1. Acceptance of terms

By creating an account or using MyCOURTpilot (the “Service”), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. Service description

MyCOURTpilot is a session-management tool for organizers of recreational pickleball games. It helps organizers manage rosters, schedule sessions, collect RSVPs, run tournaments, and notify players via SMS about session availability.

3. Accounts and organizer responsibilities

You must be at least 18 years old to create an organizer account. You are responsible for safeguarding your account credentials and for any activity that occurs under your account.

When you add players to your roster, you represent that (a) you have collected each player’s phone number directly from them with their knowledge, and (b) you have the player’s consent to receive transactional SMS from MyCOURTpilot related to your sessions. You are responsible for the accuracy of the player records you create.

4. Acceptable use

You agree not to use the Service to:

  • Send marketing, promotional, or unsolicited messages
  • Send messages to recipients who have not consented or who have opted out
  • Violate any applicable law, including the Telephone Consumer Protection Act (TCPA) and CAN-SPAM Act
  • Harass, abuse, or harm another person
  • Attempt to reverse-engineer, decompile, or otherwise extract the source code of the Service
  • Use the Service to compete with MyCOURTpilot or to develop a competing service

We reserve the right to suspend or terminate accounts that violate these rules.

5. SMS messaging

Outbound SMS sent through the Service is governed by our Privacy Policy (Section 5). Players may opt out by replying STOP to any message, which is honored automatically, and may reply HELP for assistance. Full messaging terms and sample messages are published on our SMS Messaging Terms page. Message and data rates may apply. You acknowledge that we maintain a daily send cap and reserve the right to throttle or suspend sending if abuse patterns are detected.

6. Player data responsibility

As an organizer, you act as the controller of the player records you create within your account. You are responsible for honoring any data-access or deletion requests your players make to you directly. MyCOURTpilot processes player data on your behalf (Section 4 of the Privacy Policy details our subprocessors).

7. Availability and warranties

The Service is provided “as is” and “as available,” without warranty of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that any particular SMS will be delivered. Carrier delays, filters, and failures are outside our control.

8. Limitation of liability

To the maximum extent permitted by law, MyCOURTpilot will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim arising out of or relating to these Terms or the Service is limited to the amount you paid us in the twelve months prior to the claim, or one hundred US dollars, whichever is greater. (At the time these terms take effect, the Service is offered free of charge.)

9. Termination

You may stop using the Service and request deletion of your account at any time by contacting us. We may suspend or terminate your account if you violate these Terms, if required by law, or if we discontinue the Service. Upon termination, we will retain only the records necessary for legal, audit, or compliance purposes (e.g., outbound SMS logs).

10. Governing law

These Terms are governed by the laws of the United States and the state of the Service operator’s residence, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in that jurisdiction, and you consent to personal jurisdiction there.

11. Changes to these terms

We may update these Terms from time to time. The “Effective date” at the top of this page indicates when these Terms were last revised. Material changes will be communicated to organizers via email. Continued use of the Service after changes constitutes acceptance of the updated Terms.
